ONLINE BANKING SERVICES AGREEMENT

PLEASE READ THIS AGREEMENT CAREFULLY AND KEEP A COPY FOR YOUR RECORDS.


This Agreement and Disclosure Statement provides information about the State Bank of Townsend Online Banking service and contains the disclosures required by the Electronic Funds Transfer Act.

Please read this Agreement and disclosure information and print a copy for your records. By pressing the “I Understand and Accept” button or by using Online Banking services, you are agreeing to The State Bank of Townsend’s Online Banking Service Agreement and you are agreeing to accept delivery of the Online Banking Service Agreement and initial Electronic Fund Transfers Disclosures electronically. If you desire, you may obtain an additional copy of the Agreement and Disclosure at no charge by coming into the bank at 400 Broadway, Townsend, Montana during business hours.

SYSTEM REQUIREMENTS

To access all the features available with Online Banking, customers must use an Internet browser that supports these features. The following browser versions are supported:

WITHDRAWING YOUR CONSENT

You may withdraw your consent to receive the initial EFT disclosure and Online Banking Services Agreement by either exiting this screen or by selecting the “I Do Not Agree” button at the end of this Agreement. Consent cannot be withdrawn once you have selected the “I Understand and Agree” button at the end of this Agreement. With your initial use of Online Banking, we will request your email address. You agree to notify us immediately of any changes to your email address.

BY ACCESSING THE STATE BANK OF TOWNSEND’S WEBSITE AND ONLINE BANKING SERVICES:

  1. I agree that my use of the Online Banking Services will confirm that I have completed and reviewed this Agreement and applicable disclosures, both of which The State Bank of Townsend may amend from time to time. My initial use of any Online Banking Service in connection with my account(s) at The State Bank of Townsend constitutes my acceptance and agreement to be bound by all of the terms and conditions of this Agreement and of the Deposit Account Terms and Conditions.
     
  2.  I certify that I am authorized to use the Access ID and Password to access Online Banking services provided by The State Bank of Townsend. I understand that my Access ID and Password can be used to pay out funds from my account and that this code must be safeguarded. I authorize The State Bank of Townsend and its agents to follow any instructions transmitted by use of this code, and I agree to be bound thereby. If accessing a business or non-commercial account, I certify that I am authorized to use the Access ID and Password. The State Bank of Townsend is entitled to act upon instructions received through any Internet Banking Service under my Access ID and Password without inquiring into the identity of the person using the Access ID and Password. However, I agree that I will not, under any circumstances, disclose my Access ID or Password to any person. I acknowledge that no employee of The State Bank of Townsend needs or should ever ask for my Access ID or Password. I am liable for all transactions made or authorized using my Access ID and Password. The State Bank of Townsend has no responsibility for establishing the identity of any person or determining the validity of any transaction received using my Access ID and Password. If I provide my Access ID and/or Password to anyone, I authorize any transactions carried out by that person. The State Bank of Townsend assumes all transactions authorized by my Access ID and Password are legitimate. I hereby indemnify and release The State Bank of Townsend from any and all liability and agree not to make any claim against The State Bank of Townsend or bring any action against The State Bank of Townsend in honoring or allowing any actions or transactions where I have authorized the person performing the action or transaction to use my account or when I have provided my Access ID or Password to that person.

  3. I will notify The State Bank of Townsend at once if I believe another person has improperly obtained my Access ID/Password or has carried out un-authorized transactions. At any time during banking hours, I may ask The State Bank of Townsend to disable my Access ID or Password and issue a new one to me.
     
  4. If I have a business account I am liable for all transactions that occur on the account. As the owner of the business account I authorize all transactions made by any other persons. As the owner of the business account I agree to be liable for any other parties designated (by being given the Access ID or Password) to conduct business on the account(s)
     
  5.  For multiple party accounts, each person on a multiple party account will be liable for all transactions that are made on that account. Each person on a multiple party account authorizes all transactions made by any other signer(s) on the account(s). Each owner(s) on a multiple party account(s) agrees to be liable for the actions of the other owner(s) on the account.
     
  6.  Balance information available through The State Bank of Townsend's web services may not reflect outstanding checks, charges, or unposted transactions. Pending transactions are transactions that are presented to the Bank during the current business day or after the processing cut-off time for the previous business day (which varies between 2:00 PM and 4:00PM MDT/MST). Pending transactions may include a variety of items including, direct deposits, ACH items, ATM transactions, and check card transactions. When these items are presented to the Bank they are "memo" posted to your account. The transactions will permanently post to your account, generally, in 1-3 days depending on the item. When the amount is "memo" posted to your account, your account balance reflects these items. Your account will be increased by any deposit transaction and decreased by any withdrawal. Some transactions may cause a little confusion as to the way they are posted; check card transactions in particular. There are several instances where a check card transaction may "memo" post for an amount that is different than the actual purchase price. The authorization process used by the merchant determines the amount that "memo" posts to your account. Online account transaction history for accounts is limited. You may need to check the statements that we have previously sent to you for information prior to the first day covered by the online transaction history. Although we strive for accuracy, some information and resources provided to you using The State Bank of Townsend's internet services may contain technical or other errors, inaccuracies, omissions, typographical errors, and may become outdated. We may change our products, services, terms, conditions, and pricing at any time without notice and without first updating our web site. Nothing on our website is intended to provide legal, accounting, tax, or financial advice. You should consult your own financial advisor on such matters. Tools that you may have access to through the The State Bank of Townsend web site ( such as loan calculators) are provided for your convenience, but are not guaranteed to be error free. The State Bank of Townsend will not provide any receipt or documentation of transactions other than regular account statements.
     
  7. You may contact an employee of The State Bank of Townsend via email for general, non-urgent communications with us. As regular email is not secure, we caution against using email for transmitting any sensitive personal information. As your identity cannot be confirmed, we cannot act on any instructions received via regular email. Do not rely on an email message when reporting a lost or stolen PIN, Access ID, Password, Debit Card, or ATM Card. Do not send transfer or payment requests via email.
     
  8. The State Bank of Townsend's Online Banking services will generally be available 24 hours per day, seven days a week, except for scheduled maintenance. The services and our other products and services are not necessarily available everywhere, and may or may not be available to non-residents and non-citizens of the United States. In no event shall The State Bank of Townsend be liable for any damages whatsoever which arise out of or relate to:

    • Your inability to use or access (or use of or access) The State Bank of Townsend's internet services.
    • Your reliance on any information provided via our web site; or
    • Any other failure of performance, error, omission, interruption, defect, or any loss or delay in transmission.
     
  9. The State Bank of Townsend has the right to modify or terminate this Agreement or the Deposit Account Terms and Conditions at any time. When making changes, The State Bank of Townsend will comply with all legal notice requirements. Once this Agreement is terminated The State Bank of Townsend will not allow any additional transactions on the account, nor will additional Online Banking Services be permitted. If this Agreement is modified, your continued use of the Online Banking Services will represent your acceptance of the changes.
     
  10. It is your responsibility to protect your system's security and to protect your system against viruses, worms, malware, trojan horses, and other items of a destructive nature. You agree to use reasonable care not to introduce any such items to our web site or any services offered through the The State Bank of Townsend web site. All information and services are provided "as is" without warranty of any kind either expressed or implied. The State Bank of Townsend shall have no liability for direct, special, incidental, indirect, consequential, or exemplary damages, regardless of whether such damages arise in contract, tort (including negligence and strict liability) or otherwise for lost profits, business interruption, or loss of programs or data on your computer system, regardless of whether we were advised of the possibility thereof.
     
  11. If you are dissatisfied with any aspect of our web site or the services available via our web site, your sole and exclusive remedy is to discontinue access.
     
  12. You may not transfer, assign or delegate your rights or duties under these terms and conditions.

Online Banking Disclosure Statement
The purpose of this Disclosure Statement is to inform you of certain rights that you have under the Electronic Funds Transfer Act.

Please Note: In this statement, the words "you" and "your" each refer to the person who uses or is authorized to use Online Banking services. The words "we", "our" and "us" refer to The State Bank of Townsend.

Online Banking Services

You may access our Online Banking service using the personal Login Codes that we issue to you and that you will change when you initially enroll in the service. You will be able to conduct the following transactions:

Transfer funds between:

  • Checking account(s)
  • Savings account(s)

Make payments to:

  • Loans
  • Safecheck

Obtain the available balance(s) in:

  • Checking account(s)
  • Savings account(s)
  • Loans
  • Certificates of Deposit/IRAs

Obtain the current balance(s) in:

  • Checking account(s)
  • Savings account(s)
  • Loans
  • Certificates of Deposit/IRAs

Obtain transaction history from:

  • Checking account(s)
  • Savings account(s)
  • Loans
  • Certificates of Deposit/IRAs

ELECTRONIC FUND TRANSFERS YOUR RIGHTS AND RESPONSIBILITIES

As a consumer who uses electronic fund transfers (EFT) services, you have certain rights and responsibilities which are defined by the Electronic Fund Transfer Act (15 USC 1693,eEt seq) and Regulation E of the Federal Reserve Board (12 CFR 205). One requirement of this act is that all financial institutions must make certain disclosures to all EFT users.

This Electronic Fund Transfer disclosure does not apply to any accounts other than consumer accounts as defined by Regulation E.

  1.  Periodic Statements

    You will receive a monthly statement that shows transactions for any account that has electronic fund transfers (EFT) transactions to or from the account.

  2. Business Days
    Our business days are Monday through Friday, excluding federal holidays.

  3. Disclosure of Charges Applicable to Transfers/Transactions
    There are no fees charged for Online Banking. If a fee is established or a change is made that increases the cost or liability to you, or decreases the type of electronic fund transfers available to you, or places stricter limitations on the frequency or dollar amount of transfers, written notice of the change will be mailed to your current address as shown on our records at least 21 days before the effective date of the amendment. However, if an immediate change in terms or conditions is necessary to maintain or restore the security of an electronic fund transfers system or account, we will provide written notice of the change to you on the next periodic statement or within 30 days, unless disclosure would jeopardize the security of the system or account.

  4.  Disclosure of Account Information to Third Parties
    We may disclose information to third parties about your accounts if:

    a) It is necessary for completing transfers or; r>
    b) We have entered into an agreement to have another party provide Online Banking, Online Banking Bill Payment or;

    c) In order to verify the existence and condition of your account for a third party, such as a credit bureau or merchant or;

    d) In order to comply with government agency or court orders; or

    e) e) If you give us written permission.

  5.  Liability For Failure to Make Transfers or Payments
    If we do not complete a transfer and/or payment on time or in the correct amount, we will be liable for no more than the amount involved in the transfer or payment that is caused by our failure. However, there are some exceptions. We will not be liable if:

    a) You do not obtain a reference number through the Online Banking service at the time you initiate a transfer and/or a payment instruction or;

    b) There are insufficient funds in your account and/or your overdraft account to complete the transaction through no fault of ours or;

    c) You (or we) have closed the designated account or;

    d) You have asked us to discontinue services or we have discontinued and/or terminated your services or;

    e) The services, your equipment, the communications link, or the software is not functioning properly or;

    f) You have not provided us with the correct information for those accounts to which you designated transfers or;

    g) You (or we) have reason to believe that the transaction is unauthorized or;

    h) The failure was caused by circumstances beyond our control such as fire or other catastrophe, electrical or computer failure, flood, or interference from an outside source, and we have taken reasonable precautions to avoid these circumstances or;

    i) You attempt to complete a payment and/or transfer that does not meet the requirements for eligible accounts and ownership or;

    j) You have not properly followed the Online Banking service, instructions or;

    k) Withdrawals from eligible account(s) have been prohibited by a court order such as a garnishment or other legal process.

  6. Your Liability for Unauthorized Payments
    If you believe your Access ID and/or Password has been lost, stolen or misappropriated, we recommend that you CHANGE YOUR PASSWORD IMMEDIATELY by accessing User Options in the Online Banking service AND CONTACT US IMMEDIATELY at 406/266-3176.


    You could lose all of the money in your accounts (and your maximum overdraft line of credit) if you take no action to notify us of the loss. If you do notify us, your liability will be as follows:

    a) If you contact us within two business days of the loss or your discovery of the loss, you can lose no more than $50.00 if someone used your PIN without your permission.

    b) If you do not contact us within two business days after you learn of the loss, and we can prove that we could have prevented the loss if you had contacted us, you could lose as much as $500.00 if someone used your PIN without your permission.

    c) If your statement shows transfers or payments that you did not make, tell us at once. If you do not tell us within 60 days after the statement was mailed, you may not get back any money you lost after the 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time.
     
  7. Account Restrictions
    Your name must appear in the legal title to make transfers between accounts. You may not transfer between accounts with legal or signature restrictions. However, an account(s) may be viewed if you are an authorized signer on the account(s).
     
  8. Limits on Online Banking Transactions
    All transactions performed through our Online Service will be considered a Pre-authorized Electronic Funds Transfer.
     
  9. Fees
    There is no fee to use The State Bank of Townsend’s Online Banking service. If a fee or charge is established in the future, you will be notified in accordance with Federal Regulations.

ERROR RESOLUTION NOTICE
In Case of Errors or Questions about your Electronic Transfers

Notify us as soon as you can if you think your statement is wrong or if you need more information about a fund transfer or other transaction listed on the statement. We must hear from you no later than 60 days after we sent the FIRST statement on which the problem or error appeared.

  • Tell us your name and Account number;
  • Describe the error or the fund transfer or bill payment you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information; and
  • Tell us the dollar amount of the suspected error.

If you tell us orally, we may require that you send us your complaint or question in writing within ten (10) Business Days.

We will determine whether an error occurred within 10 business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate your complaint or question. If we decide to do this, we will credit your account within 10 business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we will not credit your account.

We will tell you the results within three (3) Business Days after completing our investigation. If we decide that there was no error, we will send you a written explanation within three (3) Business Days after we finish our investigation. You may ask for copies of the documents that we used in our investigation.
